In consideration of the Jonquil Motel LLC, Jonquil Partners LLC, Jonquil Property LLC, Sterling Noren, Eva Rupert, Eva Rupert Events LLC (hereinafter called the “Event Organizers”); furnishing services and/or equipment to enable me to participate in the Desert Adventure Rally, I agree as follows:

I, ________________ participating in events on April 8-13, 2025 understand that by signing this document I accept and assume responsibility for any and all risks, whether or not specifically itemized herein, and I acknowledge that the Event Organizers and all employees, owners, investors, property owners, family of the same and any organization that the Event Organizers represents or contracts with shall be held harmless and blameless in the event of any mishap.

I understand that riding motorcycles and any activity which are a part of the Event Organizers offerings/services may involve some risk of injury or death from various hazards, both obvious and obscure, such as but not limited to, bodily injury from falling objects, impairment from unsafe driving or unsafe driving from someone else, injury from driving out of control, equipment failure, and other risks or occurrences not set forth in this agreement.

I am prepared and aware of the possibilities of risks and will not look to any entity or individual nor hold them responsible for my or my relatives well-being or the protection from such risks whether or not those risks are known or unknown by those organizations or individuals.

I hereby expressly acknowledge and agree that no representations or warranties, expressed or implied, regarding the motorcycle(s) (including any substitute motorcycle), tires, tools, accessories, equipment, keys and vehicle documents (collectively, the “Vehicle”) or their condition thereof have been made by Event Organizers, its employees, agents, owners, investors, property owners family of the same or any organization that the Event Organizers represents or contract with (and that any statements whatsoever made by the Event Organizers outside of this waiver of liability notice are not material and have not been relied upon by me).

I hereby discharge and release Event Organizers from any liability for loss or damage resulting from any condition or defect in the Vehicle. In consideration of participating in activity with the Event Organizers, I—on my behalf and on behalf of my heirs, assigns, and representatives—do hereby irrevocably release the Event Organizers, its employees, owners, investors, and property owners, family of the same and any organization that the Event Organizers represents or contracts with, their successors and assigns from any and all claims which involve any nature of injury or death or damage to persons or property that may occur as a result of my or my parties attendance or participation in such aforementioned activities.

Examples of rights I am giving up by signing this document are, but are not limited to, the right to sue the Event Organizers in a court of law for monies or damages, the right to receive money for an accident caused by you or someone else, or the right to receive compensation of any kind for an injury you received.

______ (Initial) SEVERABILITY: If any term or other provision of this Agreement is determined to be invalid, illegal or incapable of being enforced by any rule or law, or public policy, all other conditions and provisions of this Agreement shall nevertheless remain in full force and effect so long as the economic or legal substance of the transactions contemplated hereby is not affected in any manner materially adverse to any party. Upon such determination that any term or other provision is invalid, illegal or incapable of being enforced, the parties hereto shall negotiate in good faith to modify this Agreement so as to effect the original intent of the parties as closely as possible in an acceptable manner to the end that transactions contemplated hereby are fulfilled to the extent possible.

______ (Initial) ATTORNEY FEES: In the event of any litigation arising from or related to this Agreement, or the services provided under this Agreement, the Event Organizers shall be entitled to recover from the non-prevailing party all reasonable costs incurred including staff time, court costs, attorneys fees, and all other related expenses incurred in such litigation.

______ (Initial) PRIVACY: I understand that my information will be used solely by the Event Organizers to mail or email information and updates about our products and services and that my information will not be given to a third party.

______ (Initial) PHOTOS, VIDEOS, ETC.: By signing this I give permission to the Event Organizers, and photographers or videographers assigned by the Event Organizers, to use any photos or video footage which includes me, or my party for online or promotional purposes. I also give permission to use any written quotes for promotional purposes.

______ (Initial) HOLD HARMLESS: I, on behalf of myself, my personal representatives and my heirs hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify Jonquil Motel LLC, Jonquil Partners LLC, Jonquil Property LLC, Sterling Noren, Eva Rupert, Eva Rupert Events LLC; and their owners, agents, officers and employees from any and all claims, suits or causes of action for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of motorcycles and motorcycle equipment or my participation in the Desert Adventure Rally event activities. I specifically understand that I am releasing, discharging and waiving any claims or actions that I may have presently or in the future for the negligent acts or other conduct by or of Jonquil Motel LLC, Jonquil Partners LLC, Jonquil Property LLC, Sterling Noren, Eva Rupert, Eva Rupert Events LLC; and its owners, agents, officers or employees.

WAIVER AND RELEASE OF LIABILITY

In consideration of Bill R. Dragoo and Dragoo Adventures LLC dba Dragoo Adventure Rider Training (DART); furnishing services and/or equipment to enable me to participate in the Motorcycle Rider Education Class, I agree as follows:

I fully understand and acknowledge that: (a) risks and dangers exist in my use of motorcycles and motorcycle equipment and my participation in the Motorcycle Rider Education Class activities; (b) my participation in such activities and/or use of such equipment may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability; (c) these risks and dangers may be caused by the negligence of the owners, employees, officers or agents of Bill R. Dragoo and Dragoo Adventures LLC dba Dragoo Adventure Rider Training (DART), the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of nature or other causes. These risks and dangers may arise from foreseeable or unforeseeable causes; and (d) by my participation in these activities and/or use of equipment, I hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the owners, agents, officers, or employees of or of Bill R. Dragoo and Dragoo Adventures LLC dba Dragoo Adventure Rider Training (DART) or by any other person. If I have brought a motorcycle to use in the course, I also agree that this release applies to any damage that occurs to it during the course.
